Terms and conditions of use

Preambule

Speed Connect is a service offered by BVT (hereinafter the "Service") to its Clients who have acquired the Speed Reader tool and whose legal representative has subscribed to the General Terms and Conditions of the Speed Connect Service.
By accessing and continuing to use the Service, the User (natural person duly authorised by the Clients to access the Service) accepts these General Terms and Conditions of Use.

1. Subject

The purpose of these General Terms of Use is to define the conditions of access and use of the Service by Users.

2. Access and availability

Access to and use of the Service requires :

  - an adequate broadband internet connection.
  - the use of a suitable access terminal (computer or other).
  - the acquisition of the Speed Reader tool.

By the present General Terms of Use, the User acknowledges having the necessary skills and means to access and use the Service.

BVT undertakes to make its best efforts to ensure that the Service is accessible to Users 24 hours a day, 7 days a week. However, BVT declines all liability in the event of unavailability of the Service for any reason whatsoever (particularly during maintenance periods).

BVT may under no circumstances be held liable for the reliability of data transmission, access times or any restrictions on access to the Internet network or the networks connected to it.

Access to and use of the Service is only possible by means of a specific identifier and password chosen by the User.

Each User is responsible for the storage and use of his login and password. In the event of loss or disclosure to an unauthorized third party, the User undertakes to inform BVT immediately.

3. Use of the Service

The User has, on a personal and non-exclusive basis, a right to use the Service.

This right of use allows the User to use the Service for his own needs.

The User must not use the Service for any purpose that is unlawful or contrary to these General Terms of Use.

The User undertakes not to hinder, in any way whatsoever, the proper functioning of the Service, in particular, not to block or alter the normal flow of data, not to fraudulently access, disrupt or modify the information system of the web application or all of its data.

The User declares that he accepts the risks and limits of the Internet, and in particular acknowledges that he is solely responsible for the use he makes of the information.

BVT cannot be held liable in the event of misuse of the Service by the User.

4. Intellectual Property Rights

The Service as well as each of the contents that make up the Service taken individually, in particular the computer programs and the contents including data, text, images, sounds, graphics, files, are the exclusive property of BVT or third parties who have granted it intellectual property rights. Any total or partial representation and/or reproduction of the Service or any of the content without the express authorisation of BVT is prohibited and could constitute an infringement punishable under Articles L.335-2 et seq. of the Intellectual Property Code.

The databases are protected by articles L.341-1 et seq. of the Intellectual Property Code. Any qualitatively or quantitatively substantial extraction or reuse of the contents of these databases could be sanctioned.

The brands appearing on the application are trademarks registered by BVT or by third parties. Any reproduction, imitation or use, in whole or in part, of these trademarks without express authorisation and in breach of the prohibitions provided for in Articles L.713-2 et seq. of the Intellectual Property Code could be sanctioned.

The other distinctive signs, in particular company names, trade names, signs, domain names reproduced on the application are the property of BVT or third parties and any reproduction without express authorisation could engage the liability of its author on the basis of article 1382 of the Civil Code.

5. Amendments

BVT reserves the right to modify, supplement and/or delete, and more generally to update, all or part of these General Conditions of Use at any time. BVT will inform the Users if a modification or addition has a significant impact.

If the User continues to use the Service after the addition or modification of the General Conditions of Use, he thus irrevocably accepts the modified or supplemented General Conditions of Use.

The User is therefore invited to consult them regularly.

6. Jurisdiction and applicable law

The use of the Service is governed by French law, subject to the provisions that cannot be derogated from by agreement under the law applicable to the User.

Any dispute relating to the Service shall be subject to the jurisdiction of the French courts.

Data protection policy and Cookies

Your personal data

BVT, as data controler, processes your personal data in compliance with the regulation in force.

Your data is collected and processed to enable you to access the Web Application and use the Service. The communication of your data is essential and is of a contractual nature. If you do not provide the said data, you will not be able to authenticate yourself or use the Service.

The recipients of your data are the authorised persons within BVT who are in charge of processing, as well as our sub-contractors in charge of hosting the Web Application and the support service.

Your data is kept for the entire duration of use of the Service and for a period of three years after the end of such use.

You have a right of access to your data, of correction and deletion, as well as a right of limitation, portability and a right of opposition. To exercise these rights, you can contact us at the following address : bvt@bvt.fr.

We will do our utmost to respond satisfactorily to your requests. If, for any reason whatsoever, you consider that our response is unsatisfactory, we inform you that you may lodge a complaint with the CNIL.

About cookies

We use various cookies to enhance the interactivity of the application and the Service.

What is a "cookie"? A "cookie" is a string of information, usually small in size and identified by name, that may be transmitted to your browser by a web site to which you connect. Your web browser will keep it for a certain period of time, and will send it back to the web server each time you connect to it again. Cookies have multiple uses : they can be used to memorize your customer identifier on a merchant site, the current contents of your shopping cart, an identifier allowing you to trace your navigation for statistical or advertising purposes, etc.

Cookies, which are used by BVT, enable the application to function optimally. You can block and delete them by using your browser's parameters, however your user experience may be degraded :
